2257 Compliance Statement

1. Platform Role
LuckyList.ca is an online classifieds platform. We do not produce, create, or commission any of the photographic or video content that appears on the Site. All visual content is uploaded by individual users in connection with their own classified ads. LuckyList’s role is limited to providing the technical platform on which users publish their content. We are, at most, a “secondary” provider as that term is used in 28 C.F.R. § 75 et seq.
2. User Obligations
By posting any visual depiction on luckylist.ca, the user (the “Poster”) represents and warrants:
- That every individual depicted in the visual content is at least 18 years of age (or the age of majority in the relevant jurisdiction, whichever is greater) at the time the content was created;
- That the Poster has obtained, and where applicable maintains, all consents, releases, model identifications, and records required by 18 U.S.C. § 2257 and any analogous law of the Poster’s jurisdiction;
- That the Poster will produce such records to law-enforcement officials upon a lawful and proper request; and
- That the Poster has the unencumbered right to post the content and grants LuckyList the license described in our Terms of Service.
3. Custodian of Records (Primary Producers)
For visual content the Poster has produced, the Poster — not LuckyList — is the primary producer and the custodian of records. LuckyList does not custody original-production records on behalf of any Poster.
4. Reporting Suspected Violations
If you have reason to believe that any content on luckylist.ca violates 18 U.S.C. § 2257, depicts a minor, depicts non-consensual conduct, or otherwise violates applicable law, please report it immediately:
- By email to legal@luckylist.ca with a link to the offending content and a brief description.
- To the Canadian Centre for Child Protection: cybertip.ca.
- To the U.S. National Center for Missing & Exploited Children: report.cybertip.org.
We act on credible reports without delay and cooperate fully with all law-enforcement investigations.
5. Removal & Cooperation
LuckyList reserves the right to remove any visual content at any time, with or without notice, where we suspect non-compliance with this Statement, the Terms of Service, or applicable law. We preserve content and metadata as required by valid legal process and cooperate with law enforcement.
6. Jurisdictional Note
LuckyList.ca is operated from Canada and hosted in Iceland. 18 U.S.C. § 2257 is a United States federal statute. We have nevertheless adopted the obligations described above as a matter of good practice and to support the safety of the persons depicted on the Site, regardless of jurisdictional reach.
