Terms of Service

These Terms of Service (“Terms”) govern your use of luckylist.ca (the “Site”), operated by LLSC Enterprises (“we”, “us”, “LuckyList”). By accessing the Site, posting an ad, or creating an account, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility & Adult-Content Notice

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to access, use, or post on the Site. The Site contains adult-oriented content intended for mature audiences only. By using the Site, you confirm that you meet this age requirement and consent to viewing such material.

If you are under 18, leave the Site immediately. We do not knowingly permit minors to access, post, or appear in any content on luckylist.ca.

2. Account & Posting Responsibilities

You may post a classified ad as a guest (with email validation) or by creating a registered account. You are responsible for:

The accuracy and legality of all content you post.
Maintaining the confidentiality of your login credentials.
All activity that occurs under your account or your guest posting email.
Ensuring that any person depicted in a photo or video you upload is at least 18 years of age and has consented to the depiction and to its publication on luckylist.ca.

3. Acceptable Use

You agree not to use the Site to post, transmit, or facilitate any of the following:

Content depicting, promoting, or referencing any person under 18 years of age in any sexual, suggestive, or exploitative context.
Human trafficking, sexual exploitation, coercion, or any non-consensual activity.
Solicitation of illegal services where prohibited by applicable law.
Fraud, impersonation, identity theft, or misleading offers.
Spam, scraping, automated posting, or content unrelated to the section.
Malware, viruses, or attempts to compromise the Site or other users.
Content that violates the rights of others, including intellectual property, privacy, or publicity rights.

We cooperate fully with law-enforcement investigations and report suspected child exploitation to the appropriate authorities, including the Canadian Centre for Child Protection (Cybertip.ca) and the National Center for Missing & Exploited Children (NCMEC).

4. User Content & License

You retain ownership of the content you post. By posting, you grant LuckyList a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and promote that content on and in connection with the Site (including in search results, category pages, and outbound social shares) for as long as the content is published on the Site or for a reasonable period thereafter.

You represent and warrant that you own or have all necessary rights to the content you post, and that the content does not violate any third party’s rights or any applicable law.

5. Paid Features (Bumps, Premium, VIP, LuckyCoin)

The Site offers optional paid features to increase visibility:

Bump ($5 / 5 LC) — refreshes your ad’s publish date so it appears at the top of its category.
Premium ($20 / 20 LC) — 7-day premium flag with visual highlight.
VIP ($50 / 50 LC) — 30-day premium flag.
LuckyCoin — an internal credit at a fixed rate of 1 LC = $1 USD, purchased via cryptocurrency, redeemable for the above features.

Pricing may change at any time. Paid features are subject to our Refund Policy.

6. Indemnification

You agree to indemnify and hold harmless LuckyList, LLSC Enterprises, its officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use of the Site, your posted content, your violation of these Terms, or your violation of any third-party right or applicable law.

7. Disclaimer of Warranties

The Site is provided “as is” and “as available.” LuckyList makes no warranties, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service. We do not verify the identity, claims, or services of any user. You interact with other users at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, LuckyList’s total liability to you for any claim arising from or related to the Site is limited to the greater of (a) the total fees you paid to LuckyList in the 12 months preceding the claim, or (b) CAD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, even if advised of their possibility.

9. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason — including violation of these Terms, conduct that harms other users, or activity we reasonably believe may be unlawful. Termination does not entitle you to a refund except as set out in our Refund Policy.

10. Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts located in Ontario, Canada, and you consent to that jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent change. Material changes will be highlighted on the Site. Your continued use of the Site after changes constitutes acceptance.
